Panasonic LUMIX Rental Program Terms and Conditions
Panasonic LUMIX Rental program (hereafter referred to as the “Program”) is offered by Panasonic Consumer Electronics Company, a Division of Panasonic Corporation of North America, whose registered address is Two Riverfront Plaza, Newark, New Jersey 07102 (the "Promoter").
The “Program” allows Promoter to loan out to Participants LUMIX camera Rental kit(s) (the “Rental Kit(s)”) for a 14-day period (“Free Rental period”) through the shop.panasonic.com website. All “Rental Kit(s)” will be subject to payment of a fully refundable deposit of $999.99 at the time of the Rental Kit reservation.
*The 14-day period of the “Free Rental period” starts from on the order confirmation date and ends on the deadline for drop off/returning the Rental Kit(s).
Participant’s participation in the Program constitutes Participant’s full and unconditional agreement to and acceptance of these Terms and Conditions and the decisions of Promoter, which are final and binding.

Note: Promoter’s computer is the official timekeeping device for this Program.
TERMS OF RENTAL
The “Program” is a service designed to give individuals the opportunity to evaluate LUMIX equipment to help inform and enable a prospective purchase decision. Those services are not to be used to supplement equipment for paid for and/or commercial work, or where there is no intention or consideration of a purchase in the near future. Promoter reserves the right to refuse orders, exclude claims and or participants if it is not satisfied with the information provided, or believes the service is not being used within the spirit it is intended.
ELIGIBILITY
The Program is open only to legal permanent residents of 48 the 50 United States (Alaska and Hawaii, Puerto Rico and Guam are excluded), and the District of Columbia, who are 18 years of age or older. This Program is subject to all federal, state, and local laws and regulations and is void outside the U.S. and where prohibited by law.
Basic eligibility requirements include, but are not limited to:
- The participant will be charged a $999.99 deposit when reserving the Rental kit. The $999.99 will be refunded once the Rental kit is safely returned to Promoter by the Rental kit return date.
- The Rental kit is dropped off or returned within 14 days from the order date.
- Participant will receive an exclusive coupon towards the purchase of a “NEW” version of the Rental kit used. Coupon will be valid for 30 days.
HOW TO PARTICIPATE ON PANASONIC WEBSITE.
(1) Place an order for the Rental Kit(s) at shop.panasonic.com
To qualify for the “Program,” Participant must place an order for Rental Kit on the shop.panasonic.com website. The Participant will be required to provide the information that Promoter defines below. By placing an order, the Participant confirms that they are over 18 years old and have read and understood these Terms and Conditions and agree to be bound by them and to comply with all applicable laws, rules, and regulations.
*1) The “Program” application must be made via the shop.panasonic.com website, and the participant must provide: Name, Billing Address, a valid Credit or Debit card number, and answer a short survey.
*2) Free “Rental Kit” is subject to availability. Promoter will NOT be able to guarantee the availability for each Rental Kit(s) nor be liable for the failure to make available products for any Rental Kit(s).
*3) Promoter will not process a free rental request which is in its opinion incomplete. Promoter will not be responsible for any Rental Kit(s) delays or not successfully received.
*4) A Rental Kit order includes one free 14- day rental per promotional product, per person. Participants are limited to a maximum of 4 items in a 6-month period.
*5) It is a condition of the ”Program” that the Participant declares how and where the Rental Kit will be used equipment in the short survey - this is to prevent unacceptable risks being taken with the Rental Kit provided. Promoter reserves the right to decline a request to rent if it is not satisfied with the declared purpose. It is therefore in the Participant’s best interest to provide as much details as possible with regards to the planned use of the Rental Kit.
(2) Receive the Rental Kits
After the Rental Kit order is placed, the Rental Kit(s) will be shipped to the Participant via FedEx Ground Shipping* at no additional cost.
*The Participant may choose FedEx 2 Shipping at their own expense.
Orders must be made before 1pm (ET) to ensure the Rental Kit(s) are shipped on the same day. Any “Free Rental” request made on a Saturday or Sunday will be classified as a “Monday” request and the Rental Kit(s) will be shipped out on that following Monday. In case of national holiday, “First day of Rental” will be next business day. Shipments cannot be made on weekends and nation holidays.
Rental Kit(s) may take up to 3-7 business days to deliver. Delivery within the usual timescales cannot be guaranteed to remote locations and expedited delivery cannot be provided due to limited courier availability in some areas.
Promoter will only deliver “Rental Kit(s)” to a billing address and reserves the right not to deliver an order if we believe the address isn’t secure, for example to a communal postal address or PO box. In case of any order issues, Participants will be notified as soon as possible. Goods cannot be left in a ‘safe’ or ‘secure’ location or with a neighbor. Participants are advised someone MUST be present during delivery to sign for the Rental Kit. The person signing for the Rental Kit should be the person who ordered the Rental Kit. Rental Kit risk shall pass to the Participant immediately at the time of Delivery.
The Participant shall accept delivery of the Rental Kit(s) on the day the carrier first attempts to deliver.
Where the carrier has made an attempt to deliver the Rental Kit(s), but the Participant has not been present to accept the delivery, the carrier may not come back that day and there is no guarantee what time the carrier will try to redeliver the Rental Kit on the next business day. The Rental period shall remain as shown on the Order Confirmation, unless otherwise agreed by both parties.
When delivering the Rental Kit(s), Courier may not ask for a signature at point of delivery as GPS tracking will be considered as evidence of a successful delivery, in some circumstances the Courier may attempt to take a photograph of the consignment (which will not identify a person but may capture minor details of the background to show the location of the consignment as evidence of delivery having taken place). By proceeding with an order, Participant agrees to these Terms.
The Courier duty is to deliver the Rental Kit(s) to the address written or printed on the box. They are not responsible for delivering the Rental Kit(s) to the person whose name is written or printed on the box.
The Promoter shall not be liable in respect of any consignment delivered to the delivery address where any person misrepresents their authority to receive the consignment on the Participant’s behalf; or where the Courier is delivering it in accordance with instructions from or purporting to be from the Participant.
Where the Participant uses facilities offered by the Courier to divert any part of a delivery to a different address or location, responsibility for the Rental Kit(s) shall pass to the Participant immediately.
(3) Check the Rental Kit
The equipment and accessories on rental as part of the Rental Kit(s) shall remain the absolute property of Promoter and the Participant has no right, title, or interest in the equipment and accessories, except that it is rented to the Participant for an agreed period, with the Participant accepting responsibility for the safekeeping of the equipment whilst in their possession. The full Rental Kit must be returned by the Participant in the condition in which it was received and in good working order.
All equipment and accessories included in a Rental Kit(s) are checked prior to dispatch. It is the responsibility of the Participant to check that the Rental Kit(s) items are in good working order and in an undamaged condition upon receipt.
Upon receipt, the Rental Kit(s) elements shall be examined and checked by the Participant before being use and, if found to be defective or deficient, the Participant has to inform Promoter immediately. Any defects or deficiencies remedied by the Promoter without additional charge. The Participant will be held liable for any missing Rental Kit(s) elements, defects or deficiencies. The Participants are required to check the inside of Rental kit(s) when it’s delivered to ensure there are no missing elements, defects or deficiencies and obliged to notify Promoter here https://shop.panasonic.com/pages/support-hub in such cases.
*1 : The Participant shall not assign, transfer or otherwise part with possession of the Rental Kit(s) during the period of rental. The Participant will permit Promoter at all reasonable times to inspect the equipment including procuring access to any premises where the goods are located.
*2 : Any intention to take the Rental Kit(s) outside of the US must be notified prior to commencement of the rental. Promoter reserves the right to decline rental for any overseas use.
*3 : The Participant shall take adequate and proper measures to protect the Rental Kit(s) from theft, damage, and other risks. The Participant shall not permit the Rental Kit(s) to be used for any abnormal or hazardous assignments. The Participant shall notify “Promoter” of any change of address, and upon Promoter’s request, provide details of the location of the Rental Kit(s).
*4 : Promoter will not be liable in respect of any loss or damage caused by or resulting from any variation for whatever reason in the manufacturer’s specifications or technical data and will not be responsible for any loss or damage resulting from curtailment or cessation of supply following such variation.
(4) Return the Rental Kit
The participant will receive a “Return Notification” via email from the Promoter 3 days prior to the deadline of drop off for returning the Rental Kit(s). Upon receipt of the notification, the participant must drop off and return the Rental Kit within 3 days by following the procedures below:
1 : Access to “Return Portal” link included in the “Return Notification” email
2 : Fill out the necessary information including the short survey
3 : Once the “return request” is submitted, the participant will be provided with a digital return shipping label
4 : The Participant must drop off or return the Rental Kit as delivered - using the appropriate packaging securely sealing the package. The Participant shall be liable for any loss of or damage to the Rental Kit(s) in transit resulting from failure to repackage as per these instructions.
*Extended return Policy : If the Participant fails to drop off or return the Rental Kit(s) within in 14th days from the date the order confirmation email is sent, the Participant will be charged a failed drop off/return fee of $60. The fee will be deducted from the deposit refund amount that will be returned to the customer after inspection of the returned Rental Kit(s) is completed. Where the equipment is not returned to “Promoter” immediately following the end of the Rental Period and the Participant has failed to contact Promoter within 1 month from the date the order confirmation email was sent to explain the circumstances, Promoter will conduct an investigation and may inform the Police and report the Rental Kit(s) as stolen and will take necessary steps to recover the Rental Kit(s) including, but not limited to fully take the deposit amount of $999.99, or charging the Participant’s credit or debit card for the full price of replacement equipment.
“Promoter” is not liable for any failure by the carrier to successfully deliver the equipment.
(5) Inspection and Confirmation
Once Promoter receives the returned Rental Kit(s) and confirms there is no issue, a “return confirmation” email will be sent to the Participant along with a coupon code. The coupon code is valid for the purchase of the camera/lens models included in the “Rental Kit” and is valid for 30 days. Participant must purchase through the shop.panasonic.com website.
For LUMIX EDU members, the discount offer will consist of “Expedited free shipping” instead of a discount coupon code.
LOSS OR DAMAGE TO RENTAL KIT
The Participant shall be responsible for the safe keeping of the Rental Kit(s) elements throughout the rental period and shall be liable to the “Promoter” for all loss of or damage however caused.
The Participant shall not remove any labels from and/or interfere with the Rental Kit(s) elements or make any permanent modifications to them. The Participant will only use the Rental Kit(s) elements in a safe and correct manner in accordance with the operating manual.
The Participant will notify Promoter of any loss or damage immediately, and where theft has occurred, the police should be informed and a crime reference number provided to Promoter without unnecessary delay.
The Participant shall not carry out or attempt to carry out any repairs to Rental Kit(s) elements or Firmware updates without the prior the permission of “Promoter”. The Participant shall pay Promoter all costs for repairs. Participant shall incur on behalf of Promoter the full cost of replacing any lost elements from the Rental Kit(s), which in the reasonable opinion of the Promoter is uneconomic to repair, with new equipment of the same or similar specification to that equipment which has been lost or damaged. An administration fee of $60 will be added to each missing part Rental Kit(s) element or damaged item. The Participant shall also be liable for any loss of commercial rental income resulting from such loss or damage or for the period it takes to effect repairs, up to and including the replacement value of the Rental Kit(s) elements.
Where Rental Kit is returned with missing components, the Participant shall ensure that said components are returned to “Promoter’s” warehouse either in person, or via an approved carrier service within 1 working day of being notified. If the missing Rental Kit(s) components are not returned by this time and no agreement has been made between Promoter and the Participant, all monies owed for replacing said components will become immediately due and taken automatically from the deposit or will be debited from the Participant’s card. This includes but is not limited to batteries, cases and other ancillary items included in the Rental Kit(s).
In the event of any damage to the Rental Kit(s) elements related to use of memory cards not recommended by Promoter, the Participant shall be liable for damage. Promoter assumes no responsibility for damage or liability of any kind resulting from the use of the Rental Kit elements. All digital sensors are inspected and, where necessary, cleaned before dispatch of Rental Kit(s). Promoter assumes no responsibility for dust attracted to the chip after dispatch/collection.
Promoter will investigate all losses of whatever value thoroughly. Where the loss is suspected to be by theft, the Participant has an obligation to report the loss to the police and to obtain a crime reference number without unnecessary delay. Please note, the participant remains liable for up to the full value of the Rental Kit(s) and the Promoter reserves the right to take actions necessary to recover any costs.
RESERVATIONS
Making an enquiry either by telephone, email or in person, does not constitute an order. An Order is deemed to have been placed when you receive an Order confirmation email and at such time becomes binding subject to the cancellation policy.
The Company reserves the right to refuse the acceptance of any Order without assigning any reason for such refusal.
Upon booking of the Rental Kit(s), Promoter shall charge the full deposit fee of $999.99.
Where a Rental Kit(s), for reasons outside the Promoter’s control, ceases to be available for the duration of the rental period, Promoter shall inform the Participant as soon as is practically possible. In such an event, Promoter will endeavor to provide a suitable replacement Rental Kit. Where such Rental Kit elements are not available to fulfil all or part of that order, the Participant can cancel all or part of the order and receive a full or part refund as applicable at no extra charge.
Any times quoted for delivery are to be treated as an estimate, and the Participant acknowledges that delivery may be postponed due to circumstances outside the direct control of Promoter. In such event, Promoter shall not be liable for any damages, compensation, or penalty.
DEPOSIT
The Participant will be required to leave a deposit before Promoter will release any Rental Kit(s) The amount of deposit will be $999.99. The deposit will be secured immediately at the time the order confirmation email is sent to the participant. In the event of the funds not being paid and Promoter is not being able to contact the Participant, the reservation will be cancelled.
Promoter will release the deposit as soon as practically possible once the Rental Kit has been returned and the Promoter is satisfied all Rental Kit elements are returned and undamaged. Please allow up to 14 working days for the deposit refund to be reflected on the Participant’s credit card account.
PAYMENT
Payments for all activities booked via the Website will be processed by Promoter.
Payment of any monies payable in respect of any agreement between the Participant and Promoter shall be made before any Rental Kit is released. Promoter shall be entitled to receive full payment of the l charges from the Participant on receipt of the order.
The Participant shall pay all sums due to Promoter under this contract without any setoff, deduction, counterclaim and/or any other withholding of monies. Promoter reserves the right to charge the Participant’s credit or debit card to the full value of the equipment in the event the Participant is considered to be in breach of these Terms & Conditions.
Promoter reserves the right to amend prices at any time and without prior notice. Orders are fulfilled on the understanding that prices charged are those current at the time of dispatch.
All prices are exclusive of Value Added Tax and any similar taxes. All such taxes are payable by the Participant and will be supplied in accordance with US legislation in force at the tax point date.
CANCELLATION POLICY
Promoter reserves the right to levy a $60 administration charge for any order cancelled by the Participant after the dispatch is made. If it was before of dispatch, Participants can cancel the order at no charge.
TERMINATION
Participant agrees that any termination of its access to such services under any provision of these Terms of use may be affected without prior notice. Further, Participant agrees that the Promoter shall not be liable to Participant or any third party for any termination of your access to such services.
DISCLAIMERS
Promoter reserves the right to void, amend, and/or change this promotion at any time without incurring any liability whatsoever. Promoter specifically disclaims all warranties related to merchantability, fit for intended use, error-free or non-infringement.
Promoter reserves the right to audit any orders for the free Rental Kit(s) to ensure compliance with these Terms and Conditions and to request additional information, supporting documents or carry out background checks if deemed necessary. Promoter also reserves the right to refuse orders or exclude claims and/or Participants if it suspects that the promotion is being abused in any way. Promoter’s decisions in relation to the promotion are final and no correspondence will be entered into.
If any part of these Terms and Conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.
INDEMNIFICATION
By participating in the Program, each Participant agrees to release, indemnify and hold harmless Promoter, their respective affiliates, subsidiaries, advertising and Programs agencies, as applicable, and each of their respective agents, representatives, officers, directors, shareholders, and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising out of your participation in or association with the Program.
LIMITATION OF LIABILITY
Promoter is not responsible for any miscommunications such as technical failures related to computer, telephone, cable, incorrect dates or times printed on your purchase receipt, and unavailable network or server connections, related technical failures, or other failures related to hardware, software or virus, or incomplete, late or misdirected submissions. To the fullest extent permitted by law, Promoter shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this promotion. Promoter reserves the right to cancel, modify or suspend the Program should any computer virus, bug or other technical difficulty or other causes beyond the control of Promoter corrupt the administration, security or proper play of the Program. The Promoter will not be held responsible or liable for any technical, hardware, software, server, incorrect dates or times printed on your purchase receipt, website or other failures or damage of any kind, to the extent that this prevents the participant from or otherwise obstructs the participant to enter in the Program.
WARRANTIES
Participant warrants that it is eligible to participate in the Program and agrees to indemnify and hold harmless Promoter from any loss, damage or expense arising out of or in connection with participation in this Program or the acceptance, use or misuse of any prize.
RESERVATION OF RIGHTS
Promoter reserves the right to modify the Program Period and the Claims Period, and the right to modify, add or remove additional deadlines for any reason. Any changes will be communicated through the information Participants use to participate in the Program ; The Promoter reserves the right to verify the eligibility of all claims to protect itself against fraudulent, invalid or repetitive claims including, without limitation, to require the participant to prove that they did not return the product within a period of 30 days from the date of delivery.
PRIVACY
Participants agree that personal data submitted and any other information provided in connection with the Program may be processed, shared, and otherwise used for the purposes and within the context of the Program and any other purposes outlined in the Privacy Policy found at https://na.panasonic.com/us/privacy-policy.
In addition to the uses of personal information described in that Policy, Promoter will use information you provide through entry into the Program to administer the Program.
SEVERABILITY
The invalidity or un-enforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Program Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision was not contained herein.
GOVERNING LAW AND VENUE
Participant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Program or any prize awarded shall be resolved individually without resort to any form of class action, and exclusively by the appropriate courts located in New York, New York; and (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Program, but in no event, attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter in connection with this Program shall be governed by and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules.
