Panasonic is pleased to announce the addition of the DMC-GX1 interchangeable lens system camera as part of the LUMIX G Micro System as part of the new premium mirror-less line up - DMC-GX1 featuring high image quality and stunning performance in both response and function.
LUMIX G Micro System realizes high-quality photo images with real-to-life details through excellent resolution, image rendering and color reproduction. Taking full advantage of the 16.0-megapixel Live MOS sensor and Venus Engine, images to be shot in low-lit situations at max. 12800 high ISO sensitivity setting is stunningly clear with highly sharp resolution.
Precision Contrast AF system of LUMIX G Micro System gains even higher speed realizing approx. 0.09 second of Light Speed AF.* Consecutive shooting is also improved for 4.2 fps in 16.0-megapixel full resolution.
The DMC-GX1 records 1920 x 1080 full-HD video with stereo sound in AVCHD format which is superior in both compression efficiency and friendliness with AV equipment for playback. Advanced AF system including practical full-time AF and tracking AF is available in video recording so that every photographer can enjoy high quality video recording with minimum ease.
As a camera from the new premium line of LUMIX G Micro System, the external design of the camera has been developed with no compromising on grip, dial, coating - everything to detail. The hot shoe on the top lets you attach the optional tilt-shift Live View Finder (DMW-LVF2) of approx. 1.4x (approx. 0.7x**), 1,440,000-dot equivalent, 100% field of view. It is now compatible with UHS-I standard for the SDXC/SDHC Memory Card taking its advantage to extend performance.

High Image Quality for an Interchangeable Lens System Camera LUMIX G Micro System realizes high-quality photo images with real-to-life details through excellent resolution, image rendering and color reproduction; high-grade lens and precision AF achieves high resolution, optimal balance of resolution and noise reduction achieves lifelike image rendering and high precision auto exposure and white balance with live light metering results in the faithful color reproduction.
The 16.0-megapixel Live MOS sensor plays a big role in high quality image rendering. With the dedicated circuit which reads out signals with minimum noise, the level of noise is significantly suppressed by more than 66%. Notably max. ISO 12800 is available with DMC-GX1. In shooting at high ISO setting, S/N value is improved by approx. 200% compared with the conventional 12.1-megapixel sensor. The sensor performance improves by 6db at ISO 3200 and max. 9db at ISO 6400, resulting in the dramatically flawless picture without noise.
In addition to the high-speed signal processing with its 3 CPUs, the image processor Venus Engine boasts its excellent performance with an adoption of noise reduction technology for even higher quality of image. By separating chromatic noise from luminance noise even more accurately by applying the optimal noise reduction to each, you can capture clear and beautiful images even when shooting at high ISO sensitivity levels. By preventing the color mixture which tended to occur around the edges, any chromatic noise, not only in the gradation part but also in the edge part, are described clearly. The engine also provides selective noise reduction to the outline part to let it have more naturally-balanced curve without deterioration of the resolution. In addition, the spot-type noise which can be often seen in the dark area of the picture taken in low light situation or color bleeding on high luminance area generated by the chromatic aberration. Details are kept by optimum synthesizing of the data which is processed with resolution-priority for edge part and NR-priority for smooth part of a picture*. The result is a picture with stunning clarity if shot in low-lit situations. Furthermore, optimization of the parameter contributes to the increase of resolution.
The LUMIX G Micro System offers a total of 14 interchangeable lenses including the new power zoom X lens standard zoom lens, telephoto zoom lens, single focal length lens, wide-angle lens, fish-eye lens, macro lens – to fit any scenes and occasions.

Advanced AF System All cameras of LUMIX G Micro System adopt Contrast AF for its focus system. The Phase-difference AF system is susceptible to mechanical margin of error. However, in Contrast AF system, focusing is controlled by the image sensor so that no mechanical margin of error occurs to achieve precise focusing. Compared with the Phase difference system AF, the Contrast AF boasts higher accuracy especially in shooting with bright lens with small F value. (e.g. the accuracy of Contrast AF is approx. 90% while Phase difference AF is approx. 60% at F1.4.)
The DMC-GX1 features the approx. 0.09 second of ultra high-speed Light Speed AF* which is achieved by reducing the detection time for focusing by the synchronization of the lens and the sensor at 120 fps. Not only the accuracy but also the speed excels by far than the high-end DSLRs with Phase difference AF with the advanced Contrast AF system in DMC-GX1.
The newly added focus mode AFF (AF Flexible) locks on the focus when shutter button is half-pressed, however, if the subject moves, the focusing is reset to get the best results.
Combined with the Touch AF control, setting and focusing at the subject is incredibly easy and quick, never missing the spur-of-the-moment. Taking further advantage of Contrast AF, the DMC-GX1incorporates Full-area focusing which makes it possible to set focus on any point in the field of view. Frame composition is free and intuitive combining the touch-screen operation.
The touch-control system of DMC-GX1 immediately lets users to set focus to the subject by just touching it on the large, 460,000-dot wide-viewing angle LCD and you can even release the shutter. Once you lock on the subject by a touch, the camera tracks the subject with the AF tracking function even if it moves. Just a touch on the screen lets you select the part and the size of AF area with the 1-area AF. The 1-area AF in Face Detection even allows you to set finer focus on the eyes while capturing human face bright and clear. The Multi-area AF with 23 AF areas allows you to set a group of AF point according to the composition. In addition, Pinpoint AF function is incorporated in DMC-GX1 allowing more precise focus setting by further enlarging the focusing area. It assists, for example, setting focus right on the pupil in an eye.
In the MF assist mode, you can enlarge the part by just a touch to select 1x, 4x, 5x or 10x and smoothly move the part by dragging it on the screen. Easy Manual Control with a Variety of Shooting Assist Functions Despite its outstanding compactness, the operation on DMC-GX1 is smooth and easy with optimum layout of control buttons and the mode dial, turn-and-press dial and dedicated function buttons. The function the user changes its setting can be assigned to the 2 external buttons and 2 menus in the software tab for direct reach. In addition, a total of 4 custom setting patterns can be memorized to the camera (1 on C1 for direct switch and 3 on C2).
Now the DMC-GX1 comes with Level Gauge which lets the camera detect the horizontal/vertical angle of view with its internal level working with the acceleration sensor. Photos shot in a portrait aspect will be automatically displayed vertically whatever lens is used.
The newly incorporated One Push AE adjusts exposure with a single press of Fn (Function) button when it is over/under exposure. It is especially useful in shootin outdoor with open aperture or indoor with fast shutter speed.
Zoom operation can be controlled with touch control when the Power Zoom lens of LUMIX G Micro System is attached. Speed of zooming can be adjusted in 2 steps.
Even though the DMC-GX1 pursued the ultimate compactness, Panasonic did not compromise in the equipment of camera such as built-in flash (GN7.6, ISO160).
Finest Tuning in Every Part of the Camera As a camera from the new premium GX line of LUMIX G Micro System, the external design of the camera has been developed with no compromising in every detail. The ergonomically designed grip fits the DMC-GX1's flat profile yet easy to hold. Its tactile feeling offers more comfort thanks to the casting material resin and elastomer. The mode dial is machined with finest tuning on its pitch of spin, form of plate and shininess. Characters are sharply printed by laser so that they are easy to see and they last long. The buttons on the back also have style in the coating, spin, stamp and color.
The DMC-GX1 comes with a hot shoe for the external flash or for the new Live View Finder DMW-LVF2, which is an optional accessory.
1920 x 1080 Full-HD High Quality Video Recording LUMIX G Micro System is the camera that records not only high quality photo but also stunning video. The AVCHD format features almost twice the recording time in HD quality than the conventional Motion JPEG. A special, dedicated button on the top lets the user instantly start recording videos while shooting photos without any having to make any extra settings. Now the DMC-GX1 can record high-resolution full-HD videos 1920 x 1080 at 60i (NTSC) / 50i in AVCHD (Sensor output is 30p [NTSC])*. Image recording is more flexible fun with the DMC-GX1. In addition to the practical full-time AF, the Touch AF in video recording also lets users enjoy professional-like rack focusing. Just by pointing the subject, the focus is shifted to it and let it stand out to attract attention.
The Extra Tele Conversion function virtually extends the zoom range Max.4.8x without deterioration of image quality in smaller resolution.
Even video beginners can record excellent video with the DMC-GX1 because the popular iA and iA Plus modes are also available in video recording. Optical Image Stabilizer (O.I.S.) helps prevent handshake when using high-powered zoom. AF Tracking locks on the subject with focus even it moves. Face Detection automatically detects a face in the frame and adjusts focus, exposure, contrast, and skin complexion on it, so it always turns out beautiful. The Intelligent D-range Control offers natural looking by optimizing the exposure for each part of an image, preventing blocked shadows and blown highlights and helping ensure that gradation and details are reproduced beautifully including the blue color of the sky. And Intelligent Scene Selector automatically switches between Portrait, Scenery, Close-up and Low Light modes according to the situation to optimize various parameters for higher visual quality.
High quality sound can be recorded with Dolby® Digital Stereo Creator. A Wind Cut function is also available to block out most of the noise from background wind. The DMC-GX1 can take a photo while recording video by just pressing a shutter button. Also, photos can be cropped out from the video and the unwanted part of the video can be removed with a video divide function.
Videos can be recorded in MP4 format to play it back directly on the PC or other portable electronic devices without a need of conversion.

Outstanding Performance in Power, Speed and Image Processing With further optimization and rationalization in electric design, the DMC-GX1 excels in energy consumption and features approx. 11%* longer battery life than the DMC-G3 which complies with the same battery pack DMW-BLD10. The DMC-GX1 is now capable of 4.2 fps consecutive shooting in 16.0-megapixel full resolution with mechanical shutter. High speed burst shooting at 20 fps with electronic shutter is also selectable according to the shooting fast-moving subject and it is possible to select the best shot later**.
The Intelligent D-range Control offers even more natural looking by optimizing the exposure for each part of an image, preventing blocked shadows and blown highlights and helping ensure that gradation and details are reproduced beautifully including the blue color of the sky.
DMC-GX1 compiles the Intelligent Resolution technology to perform the optimum signal processing depending on the part of a picture to give a whole image outstandingly natural clearness with fine details.
Cameras of LUMIX G Micro System are equipped with highly efficient Dust Reduction System. If dust or other foreign matter gets inside the camera when you're changing lenses, it could cling to the image sensor and show up as a spot in your photos. The Dust Reduction System in the DMC-GX1 helps eliminate this possibility by placing a supersonic wave filter in front of the Live MOS sensor. Vibrating vertically around 50,000 times per second, the filter repels dust and other particles effectively.
The DMC-GX1 is compatible with UHS-I standard for the SDXC/SDHC Memory Card taking its advantage of high-speed data transmission.

Artistic Color Control Functions and iA (Intelligent Auto) Plus mode The DMC-GX1 is artistic not only in form, but also in function. It provides an array of features that let users capture precisely true-to-life images and create their own beautifully expressive images. The Creative Control offers a variety of color modes; Expressive, Retro, High Key, Sepia, High Dynamic, Miniature Effect* and newly added Low Key and Toy Effect mode.
Effect parameter of each mode is also adjustable.
The Photo Style is another option to look photos more true to your artistic intention. It has Standard, Vivid, Natural, Monochrome, Scenery, Portrait presets while enabling finer adjustment of contrast, sharpness, saturation and noise reduction by each. It is possible to fully customize those settings to make user's own color effect manually in Custom mode.
These two modes — Creative Control and Photo Style — let users at any level of skill enjoy giving photographers' intention to make the picture even more impressive and fun.
The DMC-GX1 has advanced functions that will satisfy experienced photographers, yet is easy enough for beginners of interchangeable lens camera to use comfortably in both photo and video recording with the iA (Intelligent Auto) Plus. In addition to the popular iA functions – AF Tracking, Intelligent D-range Control, Intelligent Scene Selector, Face Recognition and Intelligent ISO Control - , the iA Plus mode lets users adjust defocusing area in the background, exposure compensation and white balance for more flexible control.

Enjoy Watching High Quality Photos and Videos on Large HDTV — VIERA Link Networking Even in 3D With Panasonic's introduction of an interchangeable lens to make 3D photo shooting possible with an interchangeable lens system camera, Panasonic proposes to enjoy high-quality shooting in 3D with DMC-GX1.
Both photo and AVCHD video recorded on SD Memory Cards are easy to view on a Panasonic VIERA TV with dynamic HD resolution. The user simply inserts the card into the VIERA Image Viewer (SD Memory Card slot) on a VIERA TV or DIGA Blu-ray Disc Player** to play the content. Alternatively, an optional HDMI mini cable can be used to output still and motion images recorded with the DMC-GX1 directly to the TV for easy VIERA Link operation. This makes it possible to take maximum advantage of the camera's playback functions, including slideshows in which both still and motion images are played sequentially, or calendar displays and so on.

Rich Options for Further Expandability The Micro Four Thirds System products are joining today's Four Thirds System products to provide customers with even higher levels of performance in a digital interchangeable lens camera. In addition to LUMIX G lenses, the LUMIX DMC-GX1 can use any interchangeable lens that complies with the Four Thirds System standard via an optional Mount Adaptor for the unlimited number of lens properties.

This document sets forth the entire Contract between the Service Contract Administrator hereinafter referred to as We, Us and Our, and, the Purchaser as You and Your. No representation, promise or condition herein shall modify these terms. Service Net Warranty, LLC ("Service Net") is contractually obligated to You to provide service under this Contract where in accordance with, and as allowed by state law. If this Contract is purchased in Florida or Oklahoma, Service Net Solutions of Florida, LLCis contractually obligated to You to provide service under this contract.
1.What Is Covered. We will furnish labor, parts, and/or replacement equipment (or pay for same) necessary to repair operational or mechanical breakdowns of the product specified in this Contract, provided such service is necessitated by product failure during normal usage. The product specified and covered includes only equipment as originally configured and charged for in this Contract. Coverage also applies to the parts and accessories that are necessary to the covered product's functionality, but does not apply to accessories that are used in conjunction with or to enhance the performance of the covered product. The maximum liability owed to You under this Contract will be the full retail cost of Your Product minus the sales tax. In the event We (I) replace the Product with a Product with equivalent specifications or (II) reimburse You for the current market value of the Product with equivalent specifications or (III) reimburse You for the retail amount of the Product, less claims made, minus sales tax, We shall have satisfied all obligations owed under this contract. Power Surge and Spike: This service plan protects against operational failure of a covered product if a failure occurs while connected to a surge protector approved by the Underwriter's Laboratory. Your surge protector may be collected by the Administrator for examination.
2.TO OBTAIN AUTHORIZATION FOR REPLACEMENT (ON REPLACEMENT CONTRACTS ONLY):
You must obtain authorization prior to the receipt of a replacement Product.

Have this Contract, Your Contract number, and the original Product receipt available.
Instructions on obtaining replacement will be given.
Once authorization is obtained You may be required, at Your expense, to return the Product to Service Net.
This Product is not to be taken to the Retailer.
At Our determination, You will receive a replacement Product of like grade and quality. Technological advances may result in a replacement product with a lower selling price than the original Product. In all cases where a replacement cannot be made, You will receive reimbursement for the original purchase price, excluding sales tax, delivery and installation.
All contractual obligations are considered fulfilled upon Product replacement, reimbursement or Contract term expiration.
We reserve the right to replace the Product with a remanufactured or refurbished Product.
The replacement Product will be mailed to You at no cost.
3.DEDUCTIBLE. No deductible applies to this Contract.
4.IMPORTANT NOTE. Repairs recommended by the repairing facility not necessitated by mechanical breakdown are not covered unless specifically authorized by Us. We reserve the right to inspect the items to be covered, or the items covered, as the case may be, prior to coverage or during the coverage period. Model number, serial number and original date of purchase of all items to be covered must be provided to execute application for service. If You request a service call for a non-covered repair, You will be responsible for all osts associated with the repair. In the event You are unable to meet the servicer, You must call to cancel the appointment in advance of the agreed upon time of service. You may be responsible for paying the second trip charge for the subsequent rescheduled repair. If the product is found to be performing to the manufacturer?s specifications, it will be returned to You. This contract must be paid in full prior to services being rendered.
5.TIME FOR SERVICE. Service will be performed during the hours of 8:00 a.m. to 5:00 p.m. local time Monday through Friday, excluding holidays. Any additional costs above the service providers authorized hourly rate (premium or overtime charges) or after hours service will be at Your expense with exception of health related or severe weather related emergencies.
6.PLACE OF SERVICE. Service will be provided by a manufacturer authorized service center, or the Dealer named in this Contract. After We authorize Your claim, We will arrange for service and We will cover the reasonable parts and labor costs that We authorize. You may be asked to provide proof of purchase as a condition for receiving service under this Service Contract. Your original purchase receipt should be kept with this service Contract in a safe place. (a) On-site service will be provided for Major Appliances and televisions greater than 42 screen size. All televisions (LCD, Plasma, Projection) with a screen size between 19 and 42 may be serviced either on-site or by depot repair, at Our discretion. If depot service is required, the cost to transport and/or ship the Product for service will be paid by Us. On-site service, if applicable, will be provided when Your residence is located within fifty (50) miles of an authorized service provider. If You are entitled to on-site service but due to environmental and/or technical requirements, certain repairs can not be completed in Your residence, or if You are located more than fifty (50) miles from the nearest authorized provider, the cost to transport and/or ship the Product for service will be paid by Us. On-site service where applicable requires clear, complete and easy access to the product by the authorized service provider and does not include removal or re-installation of an installed product. It is possible that certain on-site repairs will not be completed on-site, but will require that the product or parts of the product, at the servicer's discretion be removed for shop diagnosis and/or repair and then returned. (b) All other Product categories are covered for carry-in or depot service.
7.PARTS AND SUBCONTRACTING. Parts used to repair equipment may either be new or refurbished at Our sole option. Service may be performed by subcontractors.
8.UNAVAILABILITY OF FUNCTIONAL PARTS OR TECHNICAL INFORMATION. If We determine that We are unable to repair Your Product due to the unavailability of functional parts, service or technical information, the total liability owed to You under this Contract will be the lesser of (I) the current market value of a Product with equivalent specifications or (II) the retail price paid for Your Product minus sales tax and claims paid, in lieu of service repairs or replacement of the Product with equivalent specifications. In all cases where parts or technical information are on extended backorder for a minimum of sixty (60) calendar days, We will determine if a replacement or reimbursement will be made. All contractual obligations are fulfilled, in lieu of repairs, upon Product replacement, reimbursement or Contract term expiration. Technological advances may result in a replacement Product with a lower selling price than the original Product. If We replace the Product or buyout the Contract, the covered Product becomes Our property and We may, at Our discretion, require the Product to be returned to Us (or Our designee) at Our expense.
9.RENEWABILITY. This Contract is renewable at Our sole discretion.
10.LIMITATIONS OF COVERAGE. This Contract Does Not Cover: A. Any equipment located outside the United States. B. Service required as a result of any alteration of the equipment, or repairs made by anyone other than a participating servicing dealer, an authorized service provider, its agents, distributors, contractors or licensees, or the use of supplies other than those recommended by the manufacturer. C. Damage or other equipment failure due to causes beyond our control including, but not limited to, repairs necessary due to operator negligence, the failure to maintain the equipment according to the owner?s manual instructions, abuse, vandalism, theft, fire, flood, wind, freezing, power failure, inadequate power supply, unusual atmospheric conditions, or acts of war or acts of God. D. Service necessary because of improper storage, improper ventilation, including failure to place the equipment in an area that complies with the manufacturer‘s published space or environmental requirements. Misuse, abuse and any utilization of equipment that is inconsistent with either the design of the equipment or the way the manufacturer intended the equipment to be used, including cases in which the manufacturer of the equipment would not honor any warranty. E. Any utilization of equipment that is inconsistent with either the design of the equipment or the way the manufacturer intended the equipment to be used. Any installation that prevents normal service. Any and all cases in which the manufacturer of the equipment would not honor any warranty regarding the equipment. F. Equipment used commercially or in a commercial setting. An industrial or commercial setting is defined as anything other than a single family dwelling. Single family dwellings include: Houses, Townhouses, Modular Housing, Condominiums, Duplexes, and Apartments. Equipment used in recreational vehicles is not covered. G. Cosmetic damage such as, but not limited to scratches, dents, rust, stains. Expendable or lost items, such as, but not limited to ear buds or head phones. H. Consumable items are defined as any part that is considered consumable by the manufacturer and/ or any item that is designed to be consumed (wear out) during the life of the Product, regardless if it is consumer replaceable or not. Consumable items include, but are not limited to For Consumer Electronics: light bulbs, lamps (unless purchased as additional coverage), and batteries. For Printers, Copiers, and Multifunctional Equipment: ink, fuser, roller kits, maintenance kits, paper trays, and any toner/cartridge. For all Products: Telephone or other lines connecting to the equipment. I. In-warranty parts not provided or shipped by the manufacturer. Operational or mechanical failure covered by manufacturer?s warranty, manufacturer?s recall, improper construction, or factory bulletins, (regardless of whether or not the manufacturer is doing business as an ongoing enterprise). Defects in the equipment due to the manufacturer?s error or improper construction of the equipment. J. Any software, including but not limited to, application programs, network programs, upgrades, formatting of any kind, databases, files, drivers, source code, object code or proprietary data, or any support, configuration, installation or reinstallation of any software or data. K. Normal, periodic or preventative maintenance, customer education and cleanings. L. Consequential damages as a result of malfunctioning of or damage to an operating part of the covered equipment or damages as a result of any repairs or replacements under this agreement. Damages caused by delays in rendering service or loss of use during the period that the product is at the authorized service center or otherwise awaiting parts are not covered. M. Loss or damage as a result of violation of existing federal, state and municipal codes including repairs to products not complying with said codes. N. Pre-existing conditions (incurred prior to the effective date of coverage), and known to You. O. Equipment where the serial plate attached to the equipment is removed, defaced or made illegible. P. Markings or retained images on the glass panel resulting from viewing fixed images (including, among other things, non-expanded standard 4:3 pictures on wide screen TVs, or onscreen data in a stationary and fixed location). Damaged or defective LCD screens when the failure is caused by abuse or is otherwise excluded herein. All display products that are used in an application that requires continuous and/or business operation. Q. Damage resulting from unauthorized repair; software virus; improper electrical wiring and connections; damage caused during delivery, improper installation, or setup, user facilitated minor adjustments and settings outlined in the product?s owners manual, external antenna or local reception problems, inaccessible products or parts, negligence, misuse or abuse whether willful or not. R. Payment for subsequent service calls which result in "no failure found" diagnosis. Non failure problems including but not limited to noises or squeaks. Subsequent trip charges may need to be paid by You if a second "no failure found" diagnosis is determined based on the same problem. S. Broadcast grade models are not covered by this program. Repair of resolution (pixels) failure must match the factory minimum standards before an authorized repair occurs. T. Equipment sold without a manufacturer?s warranty, sold "as is" or sold as refurbished Products or is located in a rental property. U. De-installation, removal, or reinstallation of any equipment. V. Any cost recoverable under any other warranty, guarantee, or under an insurance policy (in such case, this Contract will cover any applicable deductible). W.Transit or delivery damage, damage caused by packing, unpacking, assembly, installation, or removal. Short circuit, loss of use, parts or labor covered under the manufacturer?s warranty, lack of maintenance, bodily injury, pre-existing conditions, manufacturer?s recall, periodic checkups or maintenance. We will not pay for adjustments or repairs required because of conditions at your location. X. Electronics and PC equipment over 5 years of age.
11.NO LEMON GUARANTEE. During the term of this Contract, when three service repairs, with three separate claim numbers, have been completed on the same part, and that same part requires repair under a fourth claim number, as determined by Us, Your Product will be replaced with a Product of like grade and quality by Us, not to exceed the original retail purchase price. In the event a comparable replacement cannot be located, a buyout, not to exceed the original retail purchase price, will be provided. This does not include repairs necessary during the manufacturer?s warranty period, rework/ callback service required after initial service, during the warranty of work period provided by the Service Company, or previous service Contract terms. Once you have received Your Product replacement or buyout all contractual obligations under this Contract have been fulfilled.
12.CANCELLATION AND REFUND. You may cancel this contract at any time for any reason. If You cancel this Contract within sixty (60) days of the date purchased You will receive a refund of the full purchase price less any claims. If You cancel this Contract thereafter, You will be refunded the remaining days of coverage on a monthly prorated basis, less costs for service performed (if applicable). No refund will be issued if the prorated refund amount is less than or equal to $5.00. We, at Our sole option, may cancel this Service Contract due to non-payment. If We cancel this Service Contract due to non-payment, You will not receive a refund. Neither You nor the Dealer nor We are obligated to renew this Contract beyond the current term.
13.CLAIMS LIMITATION. The total claims limitation under this Contract is the retail price paid for Your Product minus sales tax, claims paid, delivery and installation. During the term of the Contract We may elect, at Our option, to buyout the Contract for the original purchase price of the covered Product less claims paid, less sales tax, delivery and installation, or replace the Product with a comparable Product. In the event We reimburse You or replace the Product We shall have satisfied all obligations owed under this Contract.
14.BUYOUT. We may elect, at Our option, to buyout the Contract during the coverage term for the lesser of (I) current market value of a Product with equivalent specifications or (II) retail price paid for Your Product minus sales tax and claims paid. When determining the current market value of a Product of equivalent specifications a fair analysis is completed using current manufacturers? and distributors? pricing on comparable products. All contractual obligations are considered fulfilled upon buyout of the Product. You have up to forty-five (45) days from the date of authorization to complete your product buyout transaction. Technological advances may result in a replacement product with a lower selling price than the original Product. If We buyout the contract, the covered product becomes property of Service Net and We may, at Our discretion, require the product to be returned to Us (or our designee) at Our expense.
15.STATE VARIATIONS. Certain states have specific conditions; conditions listed on the front of this form apply to You.
16.TRANSFERABILITY. You may transfer this Agreement to any person by sending written notice to: Service Net, P.O. Box 1411, Jeffersonville, IN 47131-1411.
17.NOVATION. If Service Net assigns another insurance carrier with an "AM Best" industry rating of A- or better under this Contract directly or indirectly, such new insurance carrier will carry the liability under this Contract.
18.RIGHT TO RECOVER FROM OTHERS. If we make any payment, we are entitled to recover what we paid from other parties. By accepting settlement of a claim, You transfer to us your right to recovery against any other party.
19.COVERAGE AND TERM. This is not an insurance policy. As the Administrator, We will assist You in understanding Your warranty and coverage benefits from the day You purchase Your Plan. If Your Product needs repair for operational or mechanical failure, You are required to call the toll free number listed on the front of this Contract or submit Your claim in writing to Service Net, 650 Missouri Ave., Jeffersonville, IN 47130. With any correspondence, please provide Your daytime phone number and claim number if applicable. If We fail to pay or provide service on a claim within 30 days after proof of loss has been filed, or in the event We are no longer a going concern, please enclose a copy of Your plan when sending correspondence to the Insurer. The expiration date and price of this Contract are listed on the face of this Contract. There are some limitations of coverage. You should review the limitations of coverage paragraph for details. This Plan is secured by a contractual liability or reimbursement insurance policy provided by either Illinois National Insurance Company or New Hampshire Insurance Company Inc., 175 Water Street, 20th Floor, New York, NY 10038. If, within sixty (60) days, we have not paid a covered claim, provided you with a refund or you are otherwise dissatisfied, you may make a claim directly to the insurance company.
20.ENTIRE CONTRACT. This is the entire Contract and no other oral modifications are valid.
21.LIMITATION OF LIABILITY. THE DEALER/RETAILER, SERVICE SAVER, INCORPORATED SERVICE NET, THEIR AGENTS, CONTRACTORS OR LICENSEES WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, LOST TIME, LOST DATA RESULTING FROM THE BREAKDOWN OR FAILURE OF ANY EQUIPMENT OR FROM DELAYS IN SERVICING OR THE INABILITY TO RENDER SERVICE ON ANY COVERED EQUIPMENT. EXCLUSION IS MADE OF ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES MADE HEREIN.
